Using the Digital Clinic application

Terms of use of the OmaPirha Digital Clinic service

1. Application of the terms of use

The use of the OmaPirha Digital Clinic service requires that the user accepts and undertakes to comply with these terms of use.

2. The service provider and the technical implementer of the application

The service is provided by the Wellbeing Services County of Pirkanmaa (Pirha), www.pirha.fi.
The technical implementation of the application is carried out by BeeHealthy Oy (Business ID: 3142662-9), www.mehilainen.fi/beehealthy.

3. Purpose and contents of the OmaPirha Digital Clinic service

The OmaPirha Digital Clinic service allows the user to quickly and safely communicate with a professional in health-related matters. The service enables remote access, secure video appointments, and non-urgent exchange of messages. The user can read instructions related to their treatment and contact the unit of Pirha health services that treats them.

The health care professionals will have access to the messages and questionnaires sent and filled out by the user. However, immediate reading of messages sent via the service cannot be guaranteed. If the matter is important or urgent, the user should always contact the unit providing the treatment by telephone.

In connection with treatment, a professional may process the information provided by the user and save it in a separate patient information system. Information stored in the patient information system is also available to other health care professionals.

4. User’s responsibility for the use of OmaPirha Digital Clinic service

The OmaPirha Digital Clinic service is intended to support the treatment given to the user. However, the user is solely responsible for their health when using the service. When the user makes decisions on their state of health, they must base them on their own discretion.

The user is responsible for the correctness of the information they have provided and added in the OmaPirha Digital Clinic service. The user also assures and takes responsibility for not sending any unlawful or otherwise inappropriate material in the service. The user shall make every reasonable effort to ensure that the submitted material does not contain malware or is otherwise harmful. The OmaPirha Digital Clinic service can provide information about third-party services or links to such services.

5. Right to use the OmaPirha Digital Clinic service

Only a registered user of the OmaPirha Digital Clinic service has the right to use their user account in the OmaPirha Digital Clinic service. The service may also be used on behalf of a user by a person who, in accordance with these terms of use, has the right to register and use the service on behalf of the user.

The guardian or legal representative of an incapacitated person may use the OmaPirha Digital Clinic service on their behalf only if the guardian or legal representative would also otherwise have the right to decide on the treatment of the incapacitated person and to see patient data concerning the person in accordance with the Act on the Status and Rights of Patients (785/1992) and the Client Data Act (703/2023).

Guardians using the OmaPirha Digital Clinic service on behalf of a minor shall be jointly responsible for ensuring that the child's online service is correctly used in accordance with these terms of use and in such a way that the guardians' legal right of access to information is fulfilled.

The user, or the person using the OmaPirha Digital Clinic service on their behalf, is always solely responsible for the use of the service in accordance with these terms of use. The user shall immediately notify the service provider if they suspect that the service is being used on their behalf against their authorisation or in violation of these terms of use.

6. Processing of personal data

The data controller of the OmaPirha Digital Clinic service is the Wellbeing Services County of Pirkanmaa.
When processing users' personal data, the Wellbeing Services County of Pirkanmaa complies with the applicable data protection legislation, such as the EU General Data Protection Regulation (GDPR 2016/678) and the Data Protection Act (1050/2018) as well as good data processing practices.

With regard to the data to be stored in the patient register, the implementation of the rights of the data subject and the processing of personal data are described in the privacy statement of the patient register of the Wellbeing Services County of Pirkanmaa (only in Finnish).

7. Data security

The user understands and accepts that using online services is not fully secure. The user is responsible for the appropriate data security of their own devices, systems, identifiers and activities. The OmaPirha Digital Clinic service works online and can also be accessed via a mobile app. The supported operating systems of the OmaPirha Digital Clinic mobile application are Android and iOS. The user is solely responsible for having a mobile device suitable for the use of the service's mobile application.

The use of the OmaPirha Digital Clinic service is voluntary.

8. Copyright

The content and appearance of the OmaPirha Digital Clinic service are protected by copyright. All copyrights and other intellectual property rights related to the OmaPirha Digital Clinic service belong to the service provider and the technical implementer of the application. Copying, printing, distributing, modifying and any other commercial use of material in the OmaPirha Digital Clinic service without permission is prohibited. However, the OmaPirha Digital Clinic service allows users to print out and save material in the OmaPirha Digital Clinic service for their own private use.

9. Responsibilities and obligations of the service provider and the technical implementer of the application

The service provider and the technical implementer of the application do not guarantee the continuous or error-free operation of the OmaPirha Digital Clinic service. The OmaPirha Digital Clinic service is regularly tested to prevent malfunctions. The service provider and the technical implementer of the application have the right to suspend the service, for example, for the duration of necessary maintenance procedures.

The service provider and the technical implementer of the application are not liable in any way for any direct or indirect damage or costs caused to the user by the OmaPirha Digital Clinic service or its malfunctions. The service provider and the technical implementer of the application have the right to develop the OmaPirha Digital Clinic service, its functionality, usability and accessibility.

The technical implementer of the application is in no way responsible for matters related to the treatment of the user of the OmaPirha Digital Clinic service. In matters of care, the user should contact the unit providing the treatment.

10. Ending the use of the OmaPirha Digital Clinic service

Deleting the OmaPirha Digital Clinic application from the mobile device will not erase the user's data from the OmaPirha Digital Clinic service. The deletion of the account and data is described in more detail at Deleting an account and information in the Digital Clinic on this same page (pirha.fi/en/web/english/digitalclinic/instructions).

The implementation of the rights of the data subject and the processing of personal data in the OmaPirha Digital Clinic service are described in the privacy statement of the online services of the Wellbeing Services County of Pirkanmaa: Pirkanmaan hyvinvointialueen digitaalisten palveluiden rekisteri.

11. Other terms

The Service provider has the right to change the content of these terms of use at their discretion, if necessary. The user must agree to the updated terms of use to continue using the OmaPirha Digital Clinic service. If the user does not accept the updated terms of use, the user will not be able to continue using the OmaPirha Digital Clinic service.

These terms of contract and the OmaPirha Digital Clinic service are governed by Finnish law. Any disputes on the contract will primarily be resolved through negotiation. If no consensus can be reached in the negotiations, the disputes will be settled in Pirkanmaa District Court.

Deleting an account and information in the Digital Clinic

The user of the application has the right to delete their account, and deletion is possible by following the instructions below. When the user deletes their account, all their data for which there is no legally predetermined retention period will be removed from the application.

Deleting an account in the mobile application:

  1. Log in to the mobile application using the account you want to delete.
  2. Go to the "Me" (Me) page by selecting it from the application's sub-menu.
  3. Scroll down the page and select "Delete account."
  4. Confirm the account deletion by entering your first and last name in the provided fields.
  5. Press "Delete account."

You are now logged out. Your account will be deleted within 48 hours.

You can delete your account in the web browser by logging in with the credentials you want to delete. After logging in, select "Profile" and "Delete account."

What information is retained after deleting the account?

After deleting the account, Digichat service interaction data and patient data recorded in the patient information system during the interaction will be retained according to the retention period attachment of the customer information law (703/2023).

Data and retention period:

  • Personal information (created during account creation): not retained.
  • Digichat interaction data: retained for three (3) years from the date.
  • Notifications: not retained.
